The director of the Division of Florida Condominiums, Timeshares and Mobile Homes has confirmed that the boards of community associations and cooperatives may utilize the statutory emergency powers as provided in the Governor’s Emergency order and the provision of F.S. 718.1265, 719.128 and 720.316.
This allows rescheduling of meetings, taking actions without a meeting and other emergency powers to help protect the residents of your communities.
Meetings
The provision of the Emergency Powers Act does allow associations to Conduct board meetings and membership meetings with notice given as is practicable. Such notice may be given in any practicable manner, including publication, radio, United States mail, the Internet, public service announcements, and conspicuous posting on the condominium property or any other means the board deems reasonable under the circumstances. Notice of board decisions may be communicated as is practicable. Associations may also cancel and reschedule meetings as necessary.
If this situation continues on into the election season, the boards should plan to conduct the elections as expeditiously as possible avoiding large gatherings. Make sure you encourage social distancing which should mean we stay at least six feet from others.
If possible, technology (Zoom, Go to Meeting, Skype to name a few.) should be used to continue to conduct meetings which owners can attend from the safety and comfort of their homes. Operating and administering the community must continue and meetings are a large part of that function.
