Question: I’m a subcontractor on a job and work with a general contractor that mentioned he failed to renew his license. I asked him if it’s legal for him to continuing working until he renews his license and he assured me it is, but I’m doubting it. Is that true?
Answer: Contractor licensing rules may be found in chapter 489 of the Florida Statutes, and section 489.116 addresses your question specifically. Under the statute, a certificate holder or registrant may not engage in contracting unless the certificate holder or registrant has an active status certificate or registration. It’s pretty clear, if your license is not active, you may not engage in your profession. A contractor who engages in contracting without an active status certificate or registration may be disciplined by the Department of Business and Professional Regulation (DBPR).
